Wind Power Energy SRL is conducting market research in order to determine the estimated value of the supply contract "Purchase of machinery and technological equipment requiring installation", within the project "Establishment of an assembly factory for components of equipment in the renewable energy industry", MySMIS code 322654, funded through the Just Transition Programme, Call Code PTJ/204/PTJ_P2/NA/JSO8.1/PTJ_A10, Funding Contract No. 18/204/PTJ_P2/18.12.2024.
The market research is carried out in accordance with Section 3, point 3.2 of the Competitive Procedure approved by MFE Order No. 1284/2016.
The responses received will be used solely to substantiate the estimated value and do not legally bind any party. Economic operators who submit indicative price offers may subsequently participate in the competitive procurement procedure without any restriction.
Through the project "Establishment of an assembly factory for components of equipment in the renewable energy industry", Wind Power Energy SRL is making a strategic investment intended to contribute to the sustainable economic development of the Jiu Valley ITI area, by setting up a modern assembly factory for the renewable energy sector.
The implementation of the project aims to create a modern industrial capacity for the production and assembly of components intended for equipment in the renewable energy industry, contributing to the economic diversification of the region and to increasing the competitiveness of Hunedoara county.
The general objective of the project is the development of a productive investment and the mitigation of the socio-economic impact of the transition to climate neutrality in the Jiu Valley ITI area, by creating 42 new jobs.

In accordance with the provisions of OMFE No. 1,284 of 8 August 2016 on the approval of the competitive procedure applicable to private applicants/purchasers for the award of supply, service or works contracts financed from European funds.

Any communications related to this procurement procedure shall be made only in writing to the contact details provided in this section, for the attention of the contact person, with direct reference to the name of the procedure.
Works contract with the object: "Procurement of construction and installation works".
General object of the contract: Construction and installation works carried out within and for the proper implementation of the project "Establishment of an assembly factory for components of equipment in the renewable energy industry"
This procedure will be concluded with the signing of a works contract, in accordance with the provisions of Order No. 1284/2016.
Until the completion of all contractual obligations from the signing of the contract by both parties. The execution period of the works is 8 months but no later than 17.12.2026, with the possibility of extension in close correlation with the implementation period of the funding contract.
The overall estimated value is 21,506,216.87 lei (to which VAT is added).
Alternative offers - not accepted.
Each economic operator may submit only a single offer within this procedure, individually or in association.
Economic operators participating in this procedure are NOT entitled to:
The price is firm and CANNOT be modified throughout the validity period of the offer and of the works contract
Competitive procedure - in accordance with the provisions of Order of the Minister of European Funds No. 1284 of 08.08.2016, on the approval of the Competitive Procedure applicable to private applicants/ beneficiaries for the award of supply, service or works contracts financed from European funds.
The award of the contract will be carried out in accordance with the requirements of Order No. 1284/2016, namely the offer that brings the most advantages for achieving the purpose of the project will be chosen.
The purchaser has the right to accept any offer and to reject any or all offers under the conditions established by the legislation governing the award of contracts financed from European funds.
Taking into account the above, the Purchaser reserves the right not to contract the offer with the lowest price.
Note: According to Order of the Ministry of European Funds No. 1284/2016, this procedure does not regulate the notion of "award criterion". Thus, in order to comply with the principles of economy, efficiency and effectiveness, the private applicant/purchaser will choose the offer with the most advantages for achieving the purpose of the project/future project.
Throughout the entire procurement process via the competitive procedure, when adopting any decision, the following principles shall be taken into account:
the principle of transparency;
the principle of economy;
the principle of efficiency;
the principle of effectiveness;
the principle of non-discrimination and equal treatment.
By transparency is meant making available to the public the information regarding the application of the award procedure, so that economic operators active on the market can participate in the competition, thereby ensuring the promotion of competition. Compliance with this principle ensures the premises for compliance with the other 3 principles.
The principle of economy provides for minimizing the cost of the resources allocated for achieving the estimated results of an activity, while ensuring the appropriate quality of those results.
The principle of efficiency entails ensuring an optimal ratio between the resources used and the results obtained.
The principle of effectiveness concerns the degree of fulfillment of the specific objectives established for each planned activity, in the sense of obtaining the expected results.
The principle of non-discrimination and equal treatment entails that, at any time during the award procedure, identical rules, requirements and criteria be established and applied to all economic operators, so that they benefit from equal opportunities to become contractors, as well as ensuring the conditions for the exercise of genuine competition so that any economic operator, regardless of nationality, can participate in the award procedure and have the chance to become a contractor.

Telephone clarification requests will not be taken into account.
The above deadlines may be postponed if the purchaser receives clarification requests whose response requires changes/adjustments to the technical specifications, or to other mandatory minimum requirements, so as to ensure the time needed for preparing them, while complying with the publicity conditions.
If an economic operator/bidder is dissatisfied with the manner in which the competitive procedure was conducted, it may refer the matter to the competent courts for resolution of the case, in accordance with the provisions of Order 1284/2016.
The National Council for Solving Complaints has no competence regarding the resolution of challenges in the context of conducting the competitive procedure, in accordance with the provisions of Order No. 1284/2016.
In the event that the court decides that the challenge in question is unfounded, the private Purchaser will take action against the economic operator and its legal representatives to recover the damage caused by the non-implementation of the funding project, in the event that the non-implementation was caused by that challenge.
The following cases may lead to the rejection of offers (the list is not exhaustive):
Requirement no. 1 - Similar experience
In order to ensure the achievement of the project objectives, a high quality standard must be ensured. The bidder must present proof of having carried out, in the last 3 years, works for constructions similar in terms of complexity to the one that is the subject of the procurement (production buildings), namely civil construction works classified at least in importance category C, in accordance with the provisions of GD No. 766/1997 for the approval of certain regulations on quality in construction, with subsequent additions and amendments, under a maximum of 2 contracts whose cumulative value is at least 21,500,000.00 lei, excluding VAT.
The last 3 years required in order to demonstrate similar experience will be calculated by reference to the deadline for submitting offers.
The requirements will be considered fulfilled to the extent that the economic operator provides:
The documents will be presented in copy certified as a true copy of the original.
a) Certificate of registration (certificat constatator) issued by the Trade Register Office/by the competent authorities in the country where the bidder is registered. The information contained in the certificate must be real and current as of the deadline set for submitting offers (the certificate must not have been issued more than 90 days before the deadline for submitting offers). The document will be presented in original /legalized copy /copy certified as a true copy of the original.

Romanian language
Any document presented in a language other than Romanian must be accompanied by an authorized translation thereof into Romanian.
Minimum 60 days from the deadline for submitting offers
The envelope/parcel will contain all the documents requested in these technical specifications and will be closed and sealed.
The following minimum information will be stated on the envelope/parcel:
The envelope/parcel must be marked with the name and address of the bidder, in order to allow the offer to be returned unopened, in the event that the respective offer is declared late (submitted after the deadline for submitting offers).
An offer submitted at an address other than the one established and/or after the expiry of the deadline for submission is considered late and is returned unopened. The risks of transmitting the offer, including force majeure, are borne by the bidder.
The bidder has the right to withdraw its offer, by written request addressed to the private purchaser up to the deadline date and time for submitting offers.
The bidder may modify the content of the offer, up to the date and time set for submitting offers, by addressing to the private purchaser a request to withdraw the offer for the purpose of modification. The private purchaser is not responsible regarding the bidder's ability to submit a new, modified offer, by the deadline date and time established in the award documentation.
The risks of transmitting the offer, including force majeure, are borne by the bidder.
After completing the evaluation of all registered offers, WIND POWER ENERGY SRL will notify the winning Bidder, in writing (by post/courier/email/in person), that its offer has been accepted.
All bidders will be informed of the outcome of the procedure through the publication of the award/non-award notice on the website https://www.fonduri-ue.ro, the section intended for this procedure.
In the case of an association of economic operators, all associated economic operators will submit all the requested documents, with the exception of Forms 4 (Financial proposal) and the Technical proposal, which will be submitted only by the leader of the association, on behalf of the association.
In the case of an association, an association agreement must also be submitted.
The offer designated as the winner will be the offer that achieves the highest score following the technical and financial evaluation. The weight of the factors that will be used in the evaluation is presented in this section.
The financial offer with the lowest price will obtain the highest score, namely 40 points.
The score obtained by the other offers will be calculated according to the following formula:

B.1 Experience of the economic operator (PT1): 20 points (weight 20%)
The number of similar projects that the bidding economic operator has carried out as General Contractor or Specialty Contractor or Builder.
Score breakdown:
A similar project means a civil or industrial construction project that included the execution of structural works (resistance), architectural works and installation works (electrical and/or sanitary and/or thermal).
B.2 Professional experience of the site manager/ works manager - civil construction engineer (PT2): 20 points (weight 20%)
The number of similar projects in which the person proposed in the offer for the role of project manager / site manager held a similar role (site manager or project manager).
Score breakdown:
A similar project means a civil or industrial construction project that included the execution of structural works (resistance), architectural works and installation works (electrical and/or sanitary and/or thermal).
B.3 Implementation methodology (PT3): 20 points (weight 20%)
B.3.a Detailed presentation of the quality management procedure (PT3a): 5 points
B.3.b Detailed presentation of the bidder's own methodology or working procedure for complying with the requirements relating to the DNSH (Do No Significant Harm) principle by the executor of the construction and installation works (PT3b): 5 points
B.3.c Presentation of the procedure for periodic reporting of the contract execution status (PT3c): 5 points
B.3.d Detailed presentation of the works execution programme including: the activities, the human and material resources allocated, the scheduling of activities (start date, completion date, duration in working days), the dependencies and the main milestones (PT3d): 5 points
